A few days ago we received a frantic call from a motorcycle rider who was still in the hospital as a result of injuries he sustained in a recent accident on highway 99.  He was not interviewed at the scene of the accident because he was transported to the hospital.   The police report contained primarily information supplied by the other party.

             The facts are that our client was lane splitting and the officer that actually took the report cited our client for an unsafe lane change and placed our client at fault.  After some follow up we were able to locate 2 eye witnesses to this event and show that our client did not make an unsafe lane change at all.  It was determined by both witnesses that the traffic was moving between 5 and 10 mph and our client was lane splitting or riding between lanes of traffic.  While this may be unpopular with some, it is legal.

  • Motorcycle riders are over 25 times more likely to die in a crash than someone riding in a car and are 5 times more likely to be injured.
