Our office received a call from a former client recently who was a passenger in a car that was involved in an accident and he did not know what to do next.  It seems that neither insurance company (the drivers or the other drivers) wanted to talk with him about his injuries and yet both wanted a statement from him.  He called us and here is what we told him.

            The first thing we advised him is that it is not in his best interest to give a recorded statement to either insurance company.  He could potentially give up some of his rights by giving such a statement and when an adjustor is obtaining a statement they are frequently on a fishing expedition and may ask the questions in such a manner to taint the answer in advance.

            The next thing that should happen is for him to order his own copy of the police report and check it for accuracy.  We recently had a case where we needed to prove someone was in a car at the time of the accident because their information was not included in the report.  With this information omitted it makes it almost impossible to prove damages later.  Never rely on either insurance company to do this for you!
