As a result of an $8 Million Dollar verdict, Yellow Cab in San Francisco is considering filing Chapter 11 Bankruptcy. This move comes 6 months after the verdict found them responsible for the brain Injury and partial paralysis suffered by a passenger in a Yellow Cab vehicle.

Yellow Cab, like the entire taxi industry has seen its business ravaged by companies like Uber and Lyft who charge lower fares and can flood the street with cars at a moment’s notice. These new companies also benefit from looser restrictions.  Yellow Cab has tried to duck liability by claiming that their drivers are independent contractors and that argument echo’s the claim that both Uber and Lyft drivers have made in California courts and are asking to be classified as employees.  The lawsuit by Lyft and Uber drivers is waiting for its day in court as well.

It’s interesting and terrifying to note that Yellow Cab only carries $1 Million in liability insurance and that’s only a fraction of the $8 Million dollar judgment. In fact the Attorney in that case calls that “grossly underinsured.”  Even in the past when Yellow Cab has been hit with lawsuits they have not increased their insurance limits and instead pretend that they don’t own or operate many of the cabs and then hang their drivers and passengers out to dry claiming the drivers are independent contractors. While the injured party in this case would have a voice in bankruptcy court that adds a layer onto what is already a sad situation.

A similar situation happened in Chicago where Yellow Cab lost a $26 Million dollar verdict and in that case they filed for Bankruptcy less than 9 hours after the verdict was read in court. Yellow Cab in San Francisco asserts that business and fares are strong with an average of 15,000 people riding in a Yellow Cab on average.

This is another great reason to have as much insurance as you can reasonably afford. For some unexplainable reason there has been a recent increase in dog attacks..  This is a trend we are seeing not only in California but Nationally as well.  Again, the reasons are unclear but the impact on the victims often lasts a lifetime.

As a society we love our dogs.  They are an integral part of many families and life is better with them than without.  Having said that there are realities we have to face.  Pit Bulls are responsible for more deaths than all other breeds combined and this is a case where the owner of the dog may contribute to the aggressive nature of the breed it is also a factor in the breed of dog.  I suppose there are aggressive Labradors and yet they are seldom encountered.

While dog attacks on children in California are fairly rare they happen with far too much frequency and with horrible consequences.  When an attack happens it will often negate the companionship that a dog can provide forever. Even a previously friendly dog can turn violent without warning and in these cases, children and infants are the most common victims. California has unique problems with dog bites and fatalities. In the past several years there have been both infants and youngsters that have died after being attacked by family dogs. Dog ownership rates in California are about average for the nation, but the Golden State has more home insurance claims for dog bites than any other. In 2013, California led the nation in fatal dog attacks. All deaths were attributed to pit bulls.

In most cases severe bites are inflicted by unneutered male dogs that have been bred for their aggressive behavior. California does not permit breed-specific legislation although it does support mandatory neutering programs for certain breeds.

  • Over 4500 Motorcycle Riders were killed in 2013.

Patriot’s Day is both a celebration and remembrance of the Revolutionary War Battles of Lexington and Concord in 1776.  As a child growing up in New England I attended many Patriot’s Day celebrations.  In States that are classified as Commonwealths (Massachusetts, Kentucky, Virginia & Pennsylvania) Patriot’s Day is a State holiday.  These battles were critical in the formation and future of this great nation.

Patriots Day in Boston starts with the running of the Marathon in the morning.   There are events held throughout the day and the day ends with a Boston Red Sox game.  This year the Sox play the 4th game in a series against the Orioles.  This is a day for the community and we celebrate it as such.  This also marks the second anniversary of 2 men who tried to change that day and those celebrations.

On April 15, 2013 there were 2 pressure cooker bombs planted near the finish line of the Marathon.  These bombs killed 3 people and injured 264 other innocent people.  Many of those injuries were quite severe.  The fate of the 2 men who planned and executed this act has for the most part been decided.  One of the men was killed in a hail of gunfire from the Police and the other man was tried and found guilty on 30 charges related to the bombing.  The penalty phase of his trial starts Tuesday.

The goal of these men was to stop a long held tradition in Boston and create a sense of fear in America.  From what I can tell they failed in both areas.  There are a record number of runners in the 2015 Marathon, The Red Sox are sold out and the celebrations continue to grow.  From my point of view this is what it means to be an American and a Bostonian.

A 32 year old pregnant mom was crushed to death by a gravel trailer in her driveway and she was scheduled to have her first ultrasound the following week.  In what was described as a totally avoidable accident, a pregnant hairstylist was asked to move her car after the contractor had his loaded gravel truck in place when something went horribly wrong.

There are more ways of getting injured than there is time to list them. One of the more common ways is the slip and fall type of injury. In Maryland a man is accused of staging a slip and fall on a banana peel in a transit station and then suing the transit agency for $15,000 for his injuries. The report says that 42 year old local resident Maurice Owens injured his left leg and hip in the fall and was demanding compensation. It is reported that Mr. Owens looks into the direction of the camera he did not know was there and as the elevator door opens the video shows him appearing to thrust himself forward and then falling to the ground.
